1. Acceptance of terms
By accessing the Site, creating an account, joining our waitlist or purchasing a product, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or our products.
2. Eligibility
You must be at least 16 years old to place an order. Orders for minors should be placed by a parent or legal guardian who accepts responsibility for safe use of the product.
3. Product use and safety
Earswrap is a cosmetic adhesive intended for external use on the skin behind the ear. It is not a medical device and is not intended to diagnose, treat or cure any condition. Always follow the instructions included with each product, perform a patch test before first use, and discontinue use if irritation, redness or discomfort occurs. Keep out of reach of children and away from the eyes and mouth.
4. Orders and pricing
All orders are subject to acceptance and product availability. Prices are displayed in the currency shown at checkout and may include or exclude VAT, sales tax or duties depending on your shipping destination. We reserve the right to correct pricing or description errors and to cancel orders affected by such errors, with a full refund where applicable.
5. Shipping and delivery
We aim to dispatch orders within 2 business days. Delivery times depend on destination and carrier and are estimates only. Risk of loss and title for items pass to you upon delivery to the carrier. Customers outside the European Union and United Kingdom are responsible for any import duties, taxes and customs fees charged by the destination country.
6. Returns and refunds
Unopened products in their original packaging may be returned within 14 days of delivery for a full refund of the product price. For hygiene and safety reasons we cannot accept returns of opened or used adhesive products. Return shipping costs are the responsibility of the customer unless the product is faulty or was sent in error.
7. Regional consumer rights
Nothing in these Terms limits any statutory consumer rights you have in your country of residence. The following region-specific provisions apply where relevant.
European Union and EEA
Consumers in the EU and EEA have a 14-day right of withdrawal under Directive 2011/83/EU, beginning on the day you receive the goods. This right does not apply to sealed goods that are not suitable for return for hygiene reasons once they have been unsealed. You also benefit from the legal guarantee of conformity for two years.
United Kingdom
Consumers in the UK have rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, including a 14-day cancellation period subject to the same hygiene exception above.
United States
Products are sold subject to the warranty and remedy provisions in these Terms. Some U.S. states do not allow the exclusion or limitation of certain warranties or damages, so some of the limitations below may not apply to you.
Other regions
Customers elsewhere benefit from any mandatory consumer protection laws applicable in their jurisdiction.
8. Intellectual property
All content on the Site, including text, graphics, logos, images, videos and the Earswrap name and brand, is owned by or licensed to Earswrap and is protected by international intellectual property laws. You may not reproduce, distribute, modify or create derivative works without our prior written consent, except for personal, non-commercial use.
9. Warranty disclaimer
Except as expressly required by applicable law, the Site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, Earswrap, its directors, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill arising out of or in connection with your use of the Site or our products. Our total aggregate liability for any claim related to a product will not exceed the amount you paid for that product. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold Earswrap harmless from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of a product or your violation of any applicable law or third-party right.
12. Governing law and disputes
These Terms are governed by the laws of Spain, without regard to conflict of laws principles. Any dispute will be submitted to the competent courts of Málaga, Spain, unless mandatory consumer protection laws in your country of residence grant you the right to bring proceedings in your local courts. EU consumers may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to these terms
We may update these Terms from time to time. The updated version takes effect when posted on this page. Material changes will be highlighted at the top of this page or communicated by email where appropriate. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
